slipping transmission between 3rd and 4th 2002 Has 97000 miles.

12/2014 took to transmission shop where it was repaired with a 3 yr
warranty.. After about 5 weeks it did the same thing again but not all the
time.  I have had the veh back to the shop 5 times and it is still doing the
same thing but not all the time . Goes up to 3500/4000 rpm sometimes will
shift/sometime I have to take my foot of the accelerator to shift. Tech said it
has never happened to him.   What now? I bought this new with 103 miles  
on it.  Any suggestions?

The shop should have done the right thing and replace the entire transmission when you took the car back the 3rd time. It was obvious that the transmission was defective. If you are still going to the same shop, the technician knows that, by now, this is what he must do. If they stick to the terms of the warranty, it has already expired, but you still have to repair or replace the transmission.
