I have a 2008 Subaru Legacy outback, the ABS light came on with error code 55 on dash.

The Subaru dealership has had my car for over 70 days trying to fix the ABS
system. Nothing has worked so far, the field technician has come out and
nothing works. What deal do I make to get my car replaced. Subaru of America
wants to sell me a new car which I do not want.

Your warranty ran out 7 years ago. What do you want from them? If the dealer has had the car for 70 days either you owe them a small (large) fortune or it is just sitting there. Try another shop!
