Transmission issues?

I have a 2008 nissan maxima car starts but does
not change gears after 40 mph. While driving I can
hear a noise In the back as is the wheel are robbing  
into something not sure where the noise is coming
from.

Look on the inside of the tires on the back if this is where the noise is coming from. If there is something rubbing on the tire, you will see some marks on the inside of the tire. Could be a wheel bearing. The kind of sound, is it a hissing sound? That would be a plugged catalytic converter, and you would have problems getting over 40 mph.
