Getting dealership to buy back a "lemon-esque" MINI

Asked by GenAdams Jul 23, 2018 at 12:40 PM about the 2012 MINI Countryman S ALL4 AWD

Question type: Car Selling & Trading In

I bought a certified pre-owned 2012 MINI Countryman in March covered by an extended warranty. It is now late July and my car has been into the repair shop 6 times. Do you think this is enough to file a lemon claim in Wisconsin? Or at least have the dealer buy it back? I feel like I might have grounds for some kind of case but I want other opinions.

Here is a list of every time I have had to take it into the shop.
1. Car wouldn't start (battery issue) so I took it in to a repair shop and they said everything was fine.
2. Car wouldn't start so I took it into a repair shop which specialized in import repairs and they replaced my battery.
3. Took it in to get the oil changed and they noticed a very cracked drive belt and a leakage in my CV boot.
4. Took it in to get cracked drive belt and CV boot repaired
5. Indication of high battery drain- took it into the shop and they said the first mechanic didn't leave the correct electronic footprint indicating the battery had been replaced.
6. Took it in for a recall repair on the water pump in turbo engine and they found a coolant leak and had to replace that system and the coolant hose.
7. in addition the 3rd day after I bought my car, I took my friend for a ride and they pointed out a small crack in the windshield. I have no grounds to prove that I bought it in that condition but I highly doubt I was able to get a crack in the windshield after driving it less than 20 miles.

You didn't answer my question. I didn't ask about the MINI ownership life. I asked about my ability to bring up a lawsuit or at least get the dealer to work with me on a trade in deal. I did get the extended warranty. But doesn't the "certified pre-owned" sticker mean anything? I paid extra for the security of the inspection and I feel completely screwed over. AND in Wisconsin used cars are covered under the lemon law.

You meet some of the requirements to file a claim, check with your state's Attorney generals office or Federal Trade Commission. Dealerships don't usually do buybacks, that's though the manufacturer. Did the dealer provide you with the buyer's guide and original extended warranty paperwork? When you checked the cars history, were there other open recalls? Good luck and let me know how it goes.

Thank you for the advice. I did get the original extended warranty paperwork from the dealer but I'm not sure about a buyer's guide. I will look through my records and see what I can find. Thank you for your input!
