How can you sell a VW that fails smog due to the cheating scandal?

VW has still not fixed these cars,  so,  how do you sell it privately??  
And,  what's the loss in value?      What are these people going to do if they can't
register their cars?   What will the impact be on lost performance and poor fuel
economy?     A big problem.

Selling the car privately isn't illegal - the only cars that cannot be sold are new TDIs on dealer lots. Non-VW lots are selling used TDIs in my area. Until VW and the EPA determine a solution there shouldn't be any reason you can't register a TDI. The loss in value is unfortunate, though - TDIs have taken a tumble in resale and will continue to do so. Hopefully VW makes this right with customers in some form or fashion.
