the front spoiler on 2004 C 70 rubs/hits parking curbs. can the car function properly without it?

yes your car can function without it, but it would be better if you find a better way to secure it if it's lose and avoid speed bumps as it serves as a piece of protection.

If you're referring to the splash shield underneath the bumper, yes you can run without it. All it's there for is to keep anything from hitting the bottom of the radiator and such. I don't have one on my car either.
