Hyundai Coverage for engine before recall work was done?

2015 Santa Fe, part of class action settlement for Campaign 953, stalled on
freeway and was towed to Hyundai with engine failure and engine needs
replaced, but Hyundai corporate denied coverage because the recall work
(install of software warning device) had not yet been completed. They claim
they will only honor extended warranty on engine if recalls were taken care of.
However, to me the engine has defects that they are responsible for, whether I
had a warning device or not. I had no warning, no knocking and no low oil
lights came on. They also said there was no oil. Last oil change had been 4
months ago

And regardless, my car was in operation with a defective engine known to cause safety issues. Not everyone with recall issues can be expected to receive the notices or take care of the fix, which is nothing more than diagnostic software to alert the driver to the defective engine failing. Of course it's easier for some to blame the victim rather than the car manufacturer who put this unsafe, defective engine on the road after knowing it had issues.

You just said it, the low oil light was not on, and you had no oil due to not having the software updated. So regardless if you forgot to do it or didn't see the notice because it was lost in the mail, Hyundai Corporate is not legally bound to give you a new engine. They are calling the shots here regardless of what you think. If you think you are in the right, by saying that the engines were defective from the start, then I suggest you contact a lawyer to see if you have a case.

You just said it, the low oil light was not on, and I had no oil due to A DEFECTIVE ENGINE MANUFACTURED BY HYUNDAI, not because of not having the software updated. The lack of software did not cause the engine issue, it was caused by the defective engine which goes back to production. The software also, by the way, did not fix the defective engine, it merely was supposed to alert drivers if the defective engine problem manifested. So regardless if you forgot to do it or didn't see the notice because it was lost in the mail, Hyundai Corporate is responsible for producing the defective engine in the first place. Legal teams have already been on Hyundai for not disclosing this issue for years. So stop blaming the consumer.
