Regarding ownership, I'm confused.

Asked by Diist0rt3d Aug 22, 2017 at 07:49 PM about the 2003 INFINITI G35 Coupe RWD

Question type: General

So I bought an Infiniti g35 a few months ago and 'owe'
$500 on it. However, the place I bought it from, located in
Austin, Texas, gave me the title to the car a few months
back without me paying off the vehicle. The car was sold
under no warranty and they didn't tell me of any of the
issues that were actually wrong with it, long story short, it
was about $1400 in repaires, but anyways, the title has
NO LIEN on it and it states that the place I got it from
were the previous owners and I am the new owner. Might I
also add the title is blue, it is the official title. My only
question is, do I officially own this vehicle and do I owe
this place any money, really? I pay them through money
orders and I didn't get a loan in order to pay for this
vehicle, I put $5500 down.

Unless the title lists the seller or bank as a Lienholder, there is no official lien against the car. Look at the title, it should list a lienholder or show "No Lien". If there is some other document showing you owe money, yo may still owe them the money. But without the lien on the title, they would have to sue you in civil court if you fail to pay.

Yeah, there is no Lien, however, I did sign a piece of paper that stated if I failed to pay, that I would willingly surrender the vehicle. My only question is would I really have to surrender it if I have proof of ownership of the vehicle?

The dealer would have to take you to civil court and present the contract to prove their case. Not sure of your local laws so it is difficult to tell you for certain.

Check the laws in Texas, I think they sent you the title prematurely, but you can't transfer it into your name until they send you an "Application for Texas Title" (Form 130-U) signed by them and along with a "Release of lien" form - and you're not likely to get those until you pay them off.
