Is this problm on my Nissan a risky situation?

I have this report from the dealer: Tech notes went on test drive and verified
noise, removed strut and went on test drive noise was still there. Reinstalled
strut and torqued lower control arm bolts and sway bar link ends. Tech
removed sway bar link ends and test drove, noise was still there. Tech
swapped wheel around thinking noise was caused due to tire wear, . tech
performed alignment and torqued all nuts/bolts down. Test drove and noise
was still there. Tech started to remove interior components and had trouble
isolating the noise, tech remove trunk interior trim to inspect for loose bolts
/nuts in trunk liner and found none. Tech inspected trunk lock to possibly be
loose and have play causing noise. After numerous trial and error isolated
the noise to the c-piller. Confirmed no bulletins or tech talks about
issue/noise in assist. Contacted fwm and was told to contact dts. Per dts
perform boy adjustment.

I'm assuming the vehicle is under warranty and you bought it brand new. If they can't fix the noise, take it to another Dealer or have them let another tech look at it. If it still can't be fixed, mention The Lemon Law and the word "attorney". I bet they fix it then! Sometimes you have to be tough! Jim
