Can you tell if the transmission is bad prior to replaceing the ECM module

I am having transmission shifting problems with my 2003 RAV 4.  It's the same issue I have been reading about with the ECM/Transmission problem.  I missed the 10 year cutoff date by 4 days and Toyota will not help.  I was wondering is there was any way to tell is the transmission is bad before we replace the ECM?  The service people at the Toyota dealer are telling me that they cannot tell.
