my son bought a car wth empty converter and we notified the private dealer that sold the car and hes not doing nothing about it what can i do

If the converter is gutted that means the O2 monitor has been bypassed (very illegal to gut the converter and bypass emission system). If you contact the state they will make you get it to meet emission standards whether it's your fault or not. Contact the seller and tell him he sold you a car that was illegally modified and he can get up to a $10,000 fine. Then take him to small claims court (costs about $20 to file) and make him pay to have it repaired. Most states have a law requiring disclosure of all KNOWN defects
